These Terms of Service ("Terms") constitute a binding legal agreement between you, the user, and TAATUB ("we," "us," or "our") regarding your use of the Pharmacy OSCE Simulator mobile application (the "App") and its related services (the "Service").
Please read these Terms carefully. By downloading, creating an account, or using our App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access or use the App and should delete it from your device.
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or other means. Your continued use of the App after such changes become effective constitutes your acceptance of the new Terms.
The Service is intended for use by adults. By creating an account and using the App, you represent and confirm that you are at least 18 years of age or the age of legal majority in your jurisdiction. We do not knowingly collect information from anyone who does not meet this age requirement, and you must not use the Service if you do not meet it.
IMPORTANT: THE APP IS AN EDUCATIONAL TRAINING TOOL DESIGNED TO HELP PHARMACY STUDENTS PRACTICE MEDICATION COUNSELING SKILLS THROUGH SIMULATED PATIENT INTERACTIONS. THE APP IS NOT A LICENSED MEDICAL OR PHARMACEUTICAL CARE PROVIDER.
THE SERVICE IS FOR EDUCATIONAL AND PRACTICE PURPOSES ONLY AND IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR ACTUAL CLINICAL TRAINING. The AI-simulated patient conversations do not represent real medical scenarios and should not be relied upon for clinical decision-making. Always follow your educational institution's guidelines and consult qualified professionals for actual patient care.
EXAMINATION DISCLAIMER: The App is not affiliated with, endorsed by, or in any way officially connected to any licensing board, certification body, or examination authority. Practice scenarios in the App are independently created for educational purposes and do not represent or replicate actual examination content. Scores, grades, and evaluations provided within the App are for self-assessment purposes only and are not predictive of performance on any actual examination.
We grant you a personal, revocable, non-transferable, non-exclusive, limited license to download, install, and use the App for your personal, non-commercial purposes, strictly in accordance with these Terms. All rights not expressly granted to you are reserved by us.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account.
Access to certain features of the App requires an active, paid subscription. All subscriptions are managed through the Apple App Store or Google Play Store (the "App Store").
You retain ownership of the content generated through your use of the App, such as practice session transcripts, flashcards, and notes ("User Content"). However, by using the App, you grant us a worldwide, royalty-free, perpetual, and non-exclusive license to use, copy, modify, distribute, and display your User Content solely for the purposes of operating, improving, and providing the Service to you. This means we have the rights needed to do things like store your session history, back it up, and sync it across your devices, but it does not give us the right to make your personal content public.
You warrant and represent that your User Content is your own original work, does not violate any third-party rights, and is not unlawful, obscene, or harmful.
The App uses artificial intelligence ("AI") to simulate patient interactions through real-time voice conversations. These features are provided "as-is."
You agree not to:
You may terminate your account at any time by using the account deletion feature within the App. We reserve the right to suspend or terminate your account immediately and without notice if you violate these Terms, especially the rules of Prohibited Conduct listed in Section 8. Upon termination, your right to use the Service will cease immediately.
The App and all its original content, features, and functionality (including but not limited to all software, text, trademarks, and logos) are the exclusive property of TAATUB and are protected by international copyright, trademark, and other intellectual property laws.
You acknowledge that these Terms are between you and us, not with the App Store (e.g., Apple or Google). The App Store is not responsible for the App, its content, or for providing any maintenance and support services. Any claims relating to the App must be directed to us.
We may, from time to time, provide enhancements or updates to the App, but we are not obligated to do so. We are not required to provide any maintenance or support services for the App.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPLICITLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. YOU ACKNOWLEDGE THAT THE SERVICE MAY BE TEMPORARILY UNAVAILABLE FOR SCHEDULED MAINTENANCE, FOR UNSCHEDULED EMERGENCY MAINTENANCE, OR DUE TO CAUSES BEYOND OUR REASONABLE CONTROL, SUCH AS FAILURES OF OUR THIRD-PARTY SERVICE PROVIDERS (E.G., CLOUD HOSTING, AI SERVICES). WE ARE NOT RESPONSIBLE FOR ANY LOSS, CORRUPTION, OR DELETION OF DATA THAT MAY OCCUR AS A RESULT OF SUCH FAILURES.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TAATUB, ITS AFFILIATES, OR THEIR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP.
YOU AGREE THAT YOU WILL NOT BE ENTITLED TO ANY COMPENSATION FOR SERVICE DOWNTIME OR INTERRUPTIONS, OTHER THAN ANY REFUNDS YOU MAY BE ELIGIBLE FOR THROUGH YOUR APP STORE PROVIDER, SUBJECT TO THEIR POLICIES.
IN THE EVENT OF A LEGAL DISPUTE, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, AND CAUSES OF ACTION SHALL BE LIMITED TO THE AMOUNT OF FEES PAID BY YOU THAT ARE ATTRIBUTABLE TO THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
These Terms shall be governed by the laws of Republic of Korea, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in Republic of Korea.
These Terms constitute the entire agreement between you and us regarding the App. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
